Overview of changes in the Third Edition (major changes bolded):

Chapter 1:
Some minor edits to the notes


Chapter 2:
Added a note on the backstory of Rudolph, his wife, and wiretaps.
Added a clarification to the note following Van Buren.
Added a note on the first criminal Take it Down cases.


Chapter 3:
Added Chatrie as a main case following Carpenter.
Added a note on school resource officers following Acton.
Added a note on Case v Montana following Ferguson.
Added a note on mandatory HIV testing of sex offenders following Ferguson.


Chapter 4:

Added a note following Nelson on the OPM data breach.


Chapter 6:
Minor typographic edits


Chapter 7: 
Added a note on the settlement of Shepherd.


Chapter 8:
Added a note following Erickson on errors in criminal record information produced by consumer reporting agencies.


Chapter 9:
Added a note on the Spyfone settlement and Zuckerman’s failed attempt to have it set aside following the end of Spyfone.
Changed some of the screenshots in the X-Mode case to text for readability.
Replaced NetChoice v Bonta (ND Cal 2023) with NetChoice v Bonta (9th Circ, 2026).
Added a note following Honda on Cal. Priv’s subsequent settlement with GM.
Added a note following the Delete Act on imperfect broker compliance.


Chapter 10:
Minor typographic changes.


Chapter 11:


Chapter 12:
Minor typographical changes.



All told, the introduction of Chatrie and the replacement of Bonta were the only substantial changes. Everything else was either cleanup or mild expansion of notes. I am open to suggestions for the Fourth Edition.
